Jazz Canada reserves the right to unilaterally modify these terms at any time.

Definitions

  • User: Any person who accesses the site or any of its services.

  • User Content: Data submitted by the User on the site.

  • Participant: A User becomes a Participant upon registering on the site or for an activity offered by Jazz Canada.

  • Username and Password: Required credentials to identify a User on the site. These grant access to member-only services. Passwords are confidential.

Hosting

The site’s host is secure in accordance with commercial best practices.

Access and Use

The website jazzmtl.ca is, in principle, accessible 24/7, except during scheduled or unscheduled maintenance or in cases of force majeure. Inaccessibility does not engage Jazz Canada’s liability; however, it will do its best to restore access and communicate maintenance periods in advance.

Access requires an internet connection and compatible hardware/software, which are at the User’s own expense.

Responsibility

Jazz Canada endeavors to provide accurate information, sourced from reliable providers. However, omissions or inaccuracies may occur, and Jazz Canada cannot be held liable for any errors or lack of updates. Information is provided for reference only; Users assume full responsibility for its use.

External Links and Third-Party References

Jazz Canada is not responsible for external sites linked via hyperlinks. Users must not hold Jazz Canada liable for any content or resources found on such pages.

Intellectual Property

All logos, trademarks, and content are protected by copyright.

Photos, videos, and recordings from events or training sessions remain the property of Jazz Canada. Participants waive any rights or royalties related to their image when captured during these activities. Jazz Canada agrees to use such images solely for promotional purposes.

Users must request permission before reproducing or distributing site content and agree to use it for private purposes only. Commercial use is strictly prohibited.

Users are fully responsible for any content they upload and must avoid posting content that may harm third-party interests. Legal claims from third parties will be assumed by the User.

User content may be modified or deleted by the site at any time without prior notice or justification.

Changes to the Contract

The site may modify these terms at any time.

Duration

These terms apply indefinitely, beginning when the User accesses the service.

Governing Law

The site and its terms are governed by Quebec and Canadian law, regardless of the User’s location. In case of dispute, and after failed amicable resolution attempts, Quebec/Canadian courts will have exclusive jurisdiction.

Terms and Conditions of Sale and Use of Online Products and Services

Article 1 – Age and Consent

By accepting these Terms and Conditions, you confirm that you are of legal age in your province or have obtained consent from a parent or guardian. Use of payment methods (credit, debit, Interac, etc.) implies prior consent.

These terms apply to all purchases made on jazzmtl.ca, subject to specific conditions stated in the product or service description.

Jazz Canada is not liable for failure to perform due to force majeure, including strikes, natural disasters, terrorism, or war. It is also not liable for indirect damages such as loss of revenue or opportunity.

Jazz Canada reserves the right to modify, suspend, or terminate any part of the site without notice or liability.

Cookies must be enabled to purchase or access protected content.

Illegal or unauthorized use of our services, or transmission of destructive code (viruses, etc.), is strictly prohibited and may result in immediate termination of service.

Changes to Services and Pricing

Prices may change at any time without notice.

We may modify or discontinue any service or content without liability.

Features of Products and Services

The site allows Users to register for activities (e.g., workshops, masterclasses). These fees are non-refundable.

Registrations for group training or private lessons (quarterly or annual) are also non-refundable once a User attends at least 10% of sessions.

No refunds are provided for private lesson absences or cancellations made less than 48 hours in advance.

By validating an order, you accept the terms of sale.

Prices

All prices are in Canadian dollars and exclude taxes. Access to purchases is granted upon full payment.

Availability

Services listed are presumed available unless stated otherwise. Jazz Canada is not responsible for service availability, whether in-person or online.

Orders

You may place orders through the site. For help, contact info@jazzmtl.ca. Access to purchases is granted only after payment confirmation.

Payment Terms

All payments must be made electronically through the site and in full.

Article 2 – Refunds

If Jazz Canada cancels an activity, it will refund the prorated portion of the activity canceled. Voluntary withdrawal after 10% attendance is non-refundable.

All transactions are final unless under force majeure. Requests can be sent to info@jazzmtl.ca.

Article 3 – Refusal of Service

We reserve the right to deny access to services to any individual at any time, for any reason.

Jazz Canada does not share private data except that intercepted during standard electronic communication (e.g., cookies).

Users may not reproduce or exploit any part of the service without prior written consent.

Online Courses and Activities

Reproduction or resale of any in-person or online course or recording is strictly prohibited.

Article 4 – Prohibited Uses

You may not use the site or its content:

  • For unlawful purposes

  • To solicit illegal acts

  • To violate laws or regulations

  • To infringe on intellectual property

  • To harass, insult, defame, or discriminate

  • To submit false information

  • To upload malware

  • To collect personal information

  • For spam, phishing, crawling, scraping

  • For obscene or immoral purposes

  • To bypass security systems

Violation of these terms may result in immediate service termination.

Article 5 – Accuracy of Information

Information may not be current or accurate and should not be your sole basis for decision-making. Use at your own risk.

Older content may not be updated. We may update content but are not obligated to do so.

Article 6 – No Guarantees

We do not guarantee uninterrupted, fast, or error-free service. Use is at your own risk. Services are provided “as is” without warranties of any kind.

Jazz Canada and its affiliates are not liable for any injury, loss, or damages, including but not limited to lost profits, data, or replacement costs.

Because some jurisdictions do not allow the exclusion of certain liabilities, our liability will be limited to the maximum extent permitted by law.

Article 7 – Acknowledgment

The User understands and agrees to all pricing, rules, and clauses listed above.

Article 8 – Governing Law

This site and its terms are governed by Quebec and Canadian law. Any dispute shall be settled exclusively by Quebec/Canadian courts.
